Court orders auction of Haryana, Punjab transport departments’ cars after non-payment to retired employees

A local court ordered the auction of official cars of the Transport Departments of Haryana and Punjab in separate orders after the departments failed to comply with the court’s directives.In the first case, the court ordered the auction of a car in an execution petition filed by 72-year-old retired Haryana Transport Department employee Satpal.The petitioner stated that warrants of attachment were issued for the department’s properties and that a car was attached by the Bailiff.Officials of the Judgment Debtor (JD) had given an undertaking to the Bailiff to pay the decretal amount to him on or before the fixed date. However, despite the undertaking, the officials had not paid the decretal amount till date. He requested the sale of attached properties to secure payment of the decretal amount.The Government Pleader representing the department contended that, as a government body, the JDs require examination and approval at multiple levels before any financial disbursement.After hearing arguments, the court noted that instead of complying with the earlier judgment and decree, the department had filed an appeal after a long delay. Moreover, mere filing of an appeal does not stay execution proceedings, and no stay order had been produced. The court observed that the JDs were intentionally delaying proceedings and allowed the application for the sale of the vehicle so that Satpal could receive the benefits of the decree.The auction of the Haryana Transport Department vehicle is scheduled for April 8 and the department has been directed to submit a report after the auction by April 23.The court had earlier ordered that Satpal’s pay scale be stepped up to match that of his juniors from 1996 and directed payment of the difference in pay and pensionary benefits for the preceding 36 months.A similar order was passed for the Punjab Transport Department in the case of retired employee Sukhpal Singh. The court ordered the auction of an official vehicle after the department failed to release the due amount. The department has been directed to submit a report after the sale by April 4.
