Tensions flared in Delhi High Court as it began hearing the CBI’s appeal against a lower court order that had discharged Aam Aadmi Party (AAP) convener Arvind Kejriwal and 21 others in the excise scam case.The appeal was heard by a single judge Bench of Justice Swarna Kanta Sharma.Kejriwal arrived in the court with wife Sunita Kejriwal requesting the court to take on board his application for recusal of judge Swarna Kanta Sharma from hearing the matter. The hearing was adjourned to April 13.Kejriwal has said he will personally argue why the judge must recuse.Representing CBI in the court, Solicitor General Tushar Mehta objected to the recusal application terming the accusations “frivolous and contemptuous”. He said Kejriwal can argue the matter only after he discharges his advocate in the matter.“Courtroom is not for theatrics”, Mehta said on the presence of Kejriwal and wife in the court.Delhi High Court began hearing the CBI’s plea challenging the discharge of Arvind Kejriwal and others in the excise policy case a while ago.Kejriwal, accompanied by his wife, earlier said in the court through his counsel: “I’ve filed a recusal application. Please take it on record.”SG Tushar Mehta objected to the move, saying the prosecution will address the issue first and that a similar SLP challenging the Chief Justice’s refusal to list the matter before another judge is likely defective.Mehta said repeated allegations are being made against the institution of the judiciary and must be countered. He was referring to Kejriwal’s insinuation that Judge Sharma’s Bench won’t deliver an impartial hearing. Mehta said the prosecution will address the entire issue first.
