Court ‘sermons’ on divorce cases draw Calcutta HC ire




Kolkata: Calcutta HC recently expressed strong disapproval with trial courts “sermonising” and giving free advice in divorce proceedings. Only the couple fighting the case were the best judges of whether they could live together, given the differences between them, the court observed.In the case at hand, a trial court had told a couple seeking divorce that they ought to sacrifice their differences for the sake of their only son to reunite, and that the suit must be dismissed. “Such sermonising… needs to be deprecated, since it is only the parties to the dispute who are the best judges of whether they can live together in view of the skirmishes between themselves,” the bench said.
