Haryana RERA orders jail for five TDI directors over buyer dues

In a major setback to real estate firm TDI Infrastructure Limited, the Haryana Real Estate Regulatory Authority (HRERA), Panchkula, has ordered civil imprisonment of five of its directors in an execution case arising out of non-compliance of its orders in a homebuyer dispute.The order assumes significance as it marks one of the strongest coercive actions initiated by HRERA against senior functionaries of a major real estate developer operating across Punjab and Haryana.As per a copy of the order issued on May 15 made available to The Tribune on Thursday, HRERA member Chander Shekhar directed that managing director Kamal Taneja, directors Devki Nandan Taneja, Ravinder Kumar Taneja, Renu Taneja and Ved Prakash be sent to civil imprisonment for three months for “intentional violation” of the authority’s orders.The order was passed in Execution no. 1208 of 2024 linked to Complaint no. 2950 of 2019 filed by Narender Kumar against TDI Infrastructure Limited.The authority observed that the company and its directors repeatedly failed to comply with directions issued under Order XXI Rule 41 of the Code of Civil Procedure despite being granted opportunities to respond and settle the matter.HRERA held that the directors neither filed replies in person to the show-cause notices nor paid the costs imposed by the authority and the decree-holder. The authority termed the company’s plea for more time and recall of previous orders as a tactic to delay execution proceedings.The regulator said the directors had shown “no respect for the judicial system” by ignoring orders issued on October 31, 2025, and April 24. It further observed that the company appeared to have resources to make payment but was intentionally delaying compliance to prejudice the decree-holder.The authority ruled that once the decree-holder deposits the subsistence allowance at the rate of Rs 100 per day for each director before July 10, arrest warrants would be issued against the directors. The imprisonment would continue for three months from the date of arrest unless the company satisfies the order under execution in accordance with the law.HRERA also imposed costs of Rs 5,000 payable to the decree-holder and Rs 10,000 payable to the authority.Legal experts say the HRERA’s move sends a strong signal that regulatory orders in homebuyer disputes cannot be ignored indefinitely by builders.TDI Infrastructure has faced mounting legal and financial troubles in recent years amid allegations of prolonged project delays, diversion of funds and non-delivery of promised housing units.The Enforcement Directorate had earlier filed a prosecution complaint under the Prevention of Money Laundering Act against the company and its directors, including Ravinder Taneja, Kamal Taneja and DN Taneja, for allegedly cheating over 14,000 homebuyers across 26 projects.The ED had also provisionally attached assets worth over Rs 349 crore belonging to the company over allegations of diversion of customer funds.Several homebuyers in projects located in Kundli, Sonepat and other parts of Haryana have alleged delays stretching over a decade. Multiple execution petitions have been filed before the Haryana RERA seeking refunds, delayed possession interest and execution of conveyance deeds.The latest order is expected to boost the confidence of buyers pursuing recovery proceedings against defaulting developers, particularly in long-pending real estate disputes involving stalled housing projects.
