Court martial against Colonel not ordered so far, clarifies Army

The Army has clarified that no court martial proceedings have been ordered against a Colonel, as was stated in the report, ‘Colonel, Lt Col face court martial for irregularities in procurement of military stores’, published on June 2.Terming the matter sub judice/under due process, Col Nishant Arvind, PRO (Army), said the Army follows a well-established legal and disciplinary framework with adequate safeguards at every stage. Any action, wherever warranted, is taken strictly in accordance with the law, service rules and the principles of natural justice.Information from reliable sources available with The Tribune, however, indicates that a Summary of Evidence (SoE) — a prelude to a possible trial by General Court Martial (GCM) —had been completed earlier, and a Review Assessment of Trial (RAT) was issued by the Deputy Judge Advocate General (DJAG), 2 Corps, in April. Once a RAT is issued, only the formal convening of the GCM through a convening order remains.Moreover, while declining to stay the proceedings against the Colonel, a Division Bench of the Delhi High Court had, in October 2025, directed the Army to proceed with the disciplinary action with due expedition.
