Noting that mediation was proceeding “quite satisfactorily”, the Supreme Court on Thursday expressed the hope that the dispute between late industrialist Jattvibejay Kapur’s mother Rani Kapur and his wife Priya Kapur over the family trust would be resolved amicably.”We take notice that the mediation proceedings so far have been conducted over six sessions. The mediator has interacted with all members of the family. We are happy to note that the mediation is proceeding quite satisfactorily. We are happy to note that parties are cooperating,” a Bench of Justice JB Pardiwala and Justice K Vindod Chandran said after perusing a preliminary report filed by the mediator.The Bench had on May 7 appointed former CJI DY Chandrachud as a mediator in the dispute over the family trust and asked the parties not to do anything which may directly affect the mediation proceedings. It will be in the interest of all parties to put an end to this entire dispute amicably, otherwise it is going to be a “long drawn battle”, it had noted.Noting that the mediator has made a request to allow time till November 2 for mediation, the Bench on Thursday said, “…parties should go before the mediator with open mind and heart and see to it they don’t get dragged in a long-drawn litigation. Let the mediation proceed, we shall wait for one more report.”“If the mediation fails, we will allow you all to proceed in accordance with law. But don’t allow that day to come,” the Bench told the parties.It ordered that the fees of the mediator shall be paid from the RK Family Trust and there should not be any further debate in this regard.Rani Kapur, widow of late Dr Surinder Kapur, alleged that she has been divested of her legacy, estate and home through a fraudulent instrument called the RK Family Trust or Rani Kapur Family Trust.In her suit, Rani Kapur alleged that after she suffered a stroke in 2017, her late son Jattvibejay Kapur and his wife Priya Kapur exploited her physical condition and her assets were transferred into the family trust without informed consent.The Supreme Court had on May 14 asked Rani Kapur and Priya Kapur to settle their dispute in view of the advancing age of Rani Kapur (80).Giving a philosophical advice to the two sides embroiled in a dispute over the family trust, the Bench had said, “We all came with empty hands and we have to go with empty hands. All we carry is our souls. There has to be a will to settle the matter. Don’t go before the mediator with a heavy heart just because the court has pushed us. Each one of you try…,” the Bench had told the parties.
