The Supreme Court on Thursday refused to further relax the bail conditions of former Union minister Ajay Mishra’s son Ashish Mishra, the prime accused in the 2021 Lakhimpur Kheri violence case in which four persons were killed.“We find no ground to entertain this prayer. The application is dismissed,” a Bench of Chief Justice Surya Kant, Justice Joymalya Bagchi and Justice V Mohana said, rejecting Mishra’s plea for relaxing his bail conditions to enable him to visit his native place to take part in family functions.Seeking modification of the top court’s January 2023 bail order, Ashish Mishra’s counsel submitted that due to the existing restrictions, he was unable to attend family functions, including his daughters’ birthday celebrations.Earlier, he had been given relaxations, when asked, allowing him to spend time with his family in Lakhimpur during festivals for a specific period, after the expiry of which he was required to go back to Lucknow in terms of the court’s order.The latest plea for relaxing his bail conditions was filed by Ashish Mishra after the Uttar Pradesh Police told the top court that he and his father had no role in the alleged intimidation of witnesses in the case.In its status report, the Uttar Pradesh Police last month told the Bench that the investigation into the alleged witness intimidation was over and nothing incriminating was found against the father-son duo.The Bench was informed that the trial in the case was likely to conclude in three months.Four farmers were mowed down by an SUV in Lakhimpur Kheri when those against farm laws were holding a demonstration against Uttar Pradesh Deputy Chief Minister Keshav Prasad Maurya’s visit on October 3, 2021. In the subsequent violence, two BJP workers, a driver and a journalist were killed. It was alleged that Ashish was driving one of the cars.On January 25, 2023, the top court granted interim bail to Ashish Mishra and chose to convert it into regular bail on July 22, 2024 when it restricted his movement to Delhi or Lucknow. It had also directed the trial court to expedite the trial. On November 27, 2024, it had asked Ashish Mishra to respond to the allegations of witnesses being threatened.A Lakhimpur Kheri court had on December 6, 2022, framed charges against Ashish Mishra and 12 others for murder, criminal conspiracy and certain other offences in the case. Virendra Shukla, the 14th accused was charged under Section 201 of IPC for causing disappearance of evidence. Currently, the trial is on.
