Describing dowry deaths as a severe blot on the society, the Supreme Court has cancelled the bail granted to a man in a dowry death case by the Patna High Court saying the order was wholly unsustainable.A Bench of Justice JB Pardiwala and Justice Vijay Bishnoi noted that in a very serious crime like dowry death, the high court should have been very careful in exercising its discretion.Setting aside the high court’s bail order, the top court directed him to surrender before the jail authorities.“Dowry deaths are indeed a profound disgrace and a major social evil representing a severe violation of human rights and dignity. Despite the legal prohibitions, this practice continues to result in the unnatural deaths of thousands of women, often through murder or driven to suicide because of greed-driven demands for money or valuables from the groom’s family,” it said.Faulting the high court for not discussing anything, the top court said all that weighed with the high court was that the accused was in judicial custody and only two witnesses had been examined till date.“The high court lost sight of many important aspects of the matter, more particularly the postmortem report indicating a number of injuries on the body of the deceased, and the presumption of commission of offence,” it said.The accused contended that it was a case of suicide and the deceased was not in a stable state of mind and she allegedly jumped from the sixth floor of a building.However, the top court noted that the deceased was married to the accused for one-and-a-half year. She was found dead on September 1, 2024, at her matrimonial home under suspicious circumstances with external and internal injuries all over her body.It also took note of the fact that the postmortem report concluded that the cause of her death was haemorrhage and shock due to head injury.
