The Supreme Court on Wednesday refused to order a CBI probe into the murder of 26-year-old Tarun Butolia in a communal clash in Delhi’s Uttam Nagar area on Holi and asked the petitioners to approach the Delhi Police Commissioner for safety and security for his family members.“Everyday, CBI people come here and raise their hands and say their plate is full. Delhi Police are a professional force. Why to demoralise them?” a three-judge Bench led by Chief Justice of India Surya Kant said, expressing difficulty in ordering a CBI probe into the case.Tarun died on March 4 following serious injuries sustained in a clash between two neighbouring families that got triggered after a water balloon thrown by a girl from one community accidentally hit a woman from the other.The top court asked petitioners seeking safety and security for Tarun’s family to approach the Delhi Police Commissioner, saying some of the directions sought were essentially administrative in nature.“There is no gainsaying that the police authorities will evaluate the threat perception and will take remedial measures as may be required. If the petitioners’ grievances are still not effectively addressed, liberty is granted to approach the (Delhi) High Court,” it said.On behalf of the petitioners, advocate Vishnu Shankar Jain submitted that “Because of a water balloon, a brutal incident of lynching has happened. A boy has lost his life. In Tehseen Poonawalla’s case, this court said there should be remedial measures so far as the family is concerned…”Noting that the probe was already on, the Bench asked him to move the Delhi High Court for any related issues.Earlier, Tarun’s murder had led to violent protests in Uttar Nagar by some groups, during which two vehicles linked to some of the accused were set on fire. Police have since arrested multiple accused in connection with the case.
