Police will not act on women panel order against rapper Badshah: Haryana tells HC

In a swift turn of events, the Punjab and Haryana High Court on Thursday recorded the state’s categorical stand that the police would not act on the Haryana State Commission for Women’s direction to register an FIR and arrest rapper Badshah.Justice Jagmohan Bansal’s bench was also told that a look-out circular (LOC) issued against the rapper had been withdrawn, and he had already joined the investigation.Justice Bansal was hearing a writ petition filed by Badshah challenging the commission’s order dated March 13, whereby the commission had directed Panipat Superintendent of Police to register an FIR and arrest him “in connection with summons dated March 6”. He was represented before the bench by senior counsel Pradeep Virk, along with advocates Akshay Kumar Dahiya and Kamal Jindal.Placing instructions on record, Additional Advocate-General Ravish Kaushik informed the court on the state’s behalf that “look out circular issued against the petitioner stands withdrawn.”He further stated on instructions from the Panipat Superintendent of Police that “the police authorities are not going to take any action on the basis of the impugned order dated March 13 passed by the Haryana State Commission for Women.”The state also confirmed that “the petitioner has already joined the investigation at Panchkula.”Petition challenged commission’s arrest directionBadshah had sought quashing of the commission’s direction to the Superintendent of Police, Panipat, to register an FIR and arrest him. Virk told the bench an FIR was registered on March 6 against the singer at the cybercrime police station in Panchkula, alleging commission of an offense punishable under the provisions of the Indecent Representation of Women (Prohibition) Act and the BNS.It was registered on “account of his song ‘Tateeree’ circulated on online platforms including YouTube”.The commission, too, initially issued a summons on March 6, asking him to appear in connection with a complaint against him.  His legal representative appeared before the commission and requested a reasonable time for appearance. The commission, however, ordered FIR registration against him vide the impugned order.Petition not pressed after state standsFaced with the state’s unequivocal position, counsel for the petitioner chose not to press the matter further. Recording this, the court ordered: “Disposed of as not pressed.”
