The Trinamool Congress (TMC) on Tuesday initiated the process of drafting a notice for bringing a motion for the removal of Chief Election Commissioner (CEC) Gyanesh Kumar in Parliament by seeking signatures of MPs from both Houses. Sources said the party had drafted the notice, alleging fraud on the part of the CEC while conducting the special intensive revision (SIR), as the main ground for his removal.The party has undertaken the process of procuring signatures of members from both Houses, as it plans to bring the motion in the Lok Sabha and Rajya Sabha. On Tuesday, it had got signatures from a clutch of members on the 10-page notice for initiating the motion for Kumar’s removal, the sources said further.As reported by The Tribune, the decision to submit the notice for the motion for the CEC’s removal was taken during a meeting of the INDIA bloc leaders in Parliament on Monday (March 9).The sources added that once signatures were collected, the notice would be submitted to both the Lok Sabha and Rajya Sabha secretariats by the weekend.According to the procedure, signatures of 100 Lok Sabha MPs and 50 Rajya Sabha MPs are needed for submitting a notice for a motion for the removal of the CEC. Once the notice is cleared by the secretariats of both Houses, support of 50 MPs, who can either stand or raise their hands in its favour in the House, is needed. Subsequently, the motion can be moved for discussion and put for voting.The passage of a motion for removing the CEC further needs the support of two-thirds of the strength of an individual House at the particular point of time, which is called a special majority. The motion can be simultaneously brought in both Houses or one by one in each House. If the motion is passed by both Houses, it is sent for the President’s approval, who will then sign it.A motion for the removal of the CEC is normally brought on the grounds of proved misbehaviour or incapacity.
