Expressing hope that better sense will prevail on all concerned, the Supreme Court on Friday refused an urgent hearing on a plea against the NDMC order shutting down Central Park at Connaught Place here for two days over the proposed CJP protest.A Bench of Chief Justice of India Surya Kant and Justice Joymalya Bagchi declined to entertain the plea for urgent hearing, saying, “We hope better sense will prevail on everyone. Small shopkeepers earn their livelihood during these days. We know the hardship and difficulty entire families will face.”The Bench, however, said, “Some actions may be needed… some directions. We know that all small shopkeepers, hawkers and stall owners earn their livelihood during these days. And we know the hardship, difficulty and crisis faced by their entire families.”It hinted that the plea may be listed on October 26 or 27.Noting that various issues surrounding the protest, including the right to protest, the proposed selling of ‘mungfali’ and concerns over law and order, were interconnected, Justice Bagchi said, “Someone wants to protest, someone wants to sell ‘moongfali’, someone wants law and order. All these are related… If there’s loss of business, we will exercise our powers under Constitutional jurisdiction. Let’s cross that bridge when it comes,” Justice Bagchi said. The court’s comments came after advocate Jai Anant Dehadrai submitted on behalf of traders that the New Delhi Municipal Council (NDMC) issued directions late Thursday night to shut down Central Park, effectively stopping trade-related activities.“We are for the Kirana committee. There is a loss of over Rs 250 crore a day for the protest etc Connaught Place…And the NDMC has put out a notice last night… There is grave urgency because Karva Chauth, Dussehra, Diwali and Chhath are coming up,” Dehadrai told the Bench.“We told you, there is ample jurisdiction evolved by this court under compensation and public law. We will act,” the Bench assured him.CJP leader Abhijeet Dipke has called on “patriots” to gather with the National Flag at Central Park in Delhi’s business hub Connaught Place on Friday, alleging that its leaders Saurav Das and Ashutosh Ranka were “jailed for unfurling the Tricolour”.Das and Ranka have been sent to five-day judicial custody in Tihar Jail for allegedly violating their peace bonds and trespassing into Jantar Mantar, which was no longer a protest site.
