Motor Accident Claims Tribunal, Chandigarh has directed the insurance company, driver and the car owner to give a compensation of Rs 1,05,64,368 Poonam Kumari, wife of Suresh Kumar, who died in an accident four years ago.In a petition filed under Section 166 of the Motor Vehicles Act, through advocate Thakur Kartar Singh, Kumari said on October 20, 2022, Suresh was going to his home from DadduMajra on an active and he was driving at normal speed.At 11:30 pm, in Sector 31-32 here, an Innova car came at a high speed and hit the scooter. As a result, Suresh as well as a pillion rider Mahesh Chand fell and the driver of the vehicle dragged them to a distance of about 100 yards.Suresh was taken to the Government Medical College & Hospital, Sector 32, Chandigarh, where he was declared brought dead. The accident took place due to rash & negligent driving of the car driver. An FIR was registered in the Sector 31 police station.At the time of his death, Suresh was 34 years old and he used to run a retail-cum-wholesale chemist shop and was earning about Rs 65,000 per month.Apart from Kumari, the family includes their son and Suresh’s mother, who were dependent on him. Due to his untimely death, they have suffered a huge loss.Hence, they have sought a compensation of Rs 1 crore along with 24 per cent interest per annum from the date of filing the claim petition till the realisation of the amount.The owner of the car opposed the petition and the insurance company has stated that no such accident took place with that vehicle.After the hearing of the arguments the Tribunal has directed that respondents to pay the claimed compensation amount with an interest at the rate of 7.5 per cent per annum from the date of filing of petition till the realisation of the amount.All the respondents are jointly and severally liable to pay the compensation and the insurance company shall be liable to indemnify the insured.
