Noting that RTI activism has become a new business, the Supreme Court on Monday refused to grant anticipatory bail to an activist and his aide accused of obstructing a public servant in road construction work.“RTI activism has become a new business. The Central government has issued funds… It will take care of the construction of the road. You are nobody. So-called RTI activist! Yellow journalism… Dismissed,” a Bench of Justice Sandeep Mehta and Justice Vijay Bishnoi said, denied bail to RTI activist Rakesh Kumar Behl and his aide.The Bench questioned their authority to monitor the road construction work. “Who are you to monitor the construction of all these road progress or all? Are you some superior authority?” it asked the petitioners who had challenged the Punjab and Haryana High Court’s order turning down their anticipatory bail pleas.The petitioners’ counsel contended that they had been falsely implicated in the case as they highlighted corruption in the road construction work.“Considering the nature and gravity of the allegations; the active role attributed to the appellants and the requirement of custodial interrogation do not persuade this court to exercise discretion in favour of the appellants. No ground is made out for grant of anticipatory bail,” the high court had said in its May 14 order.The petitioner and his aide allegedly obstructed the ongoing road construction work and intimated the complainant who was supervising the work and the labourers present at the site. They allegedly inflicted blows on the complainant and kicked him.They also allegedly made caste-based derogatory remarks against labourers and an FIR was registered under various provisions of the BNS, 2023 and the SC/ST Act, 1989.
