A woman coach from Haryana has moved a Chandigarh court seeking addition of an attempt-to-rape charge against ex-Haryana minister Sandeep Singh in the molestation case against him.In her application, she has sought amendment of the charges framed against the accused to include Section 376 (attempt to rape) read with Section 511 of the Indian Penal Code (IPC), and also prayed that the case be committed to the Sessions Court for trial under Section 323 of the CrPC, as the offence is exclusively triable by a Court of Session.She stated that material already available on judicial record, including her statement recorded under Section 164 CrPC and her examination-in-chief before the court, contains clear, consistent and grave allegations against the accused.She argued that these facts are part of the record and satisfy the ingredients of an attempt to commit rape as defined under the IPC. As per law, attempt to rape under Section 376 read with Section 511 of the IPC is a serious offence.The plea further stated that failure to include this charge despite the specific testimony of the victim constitutes a legal oversight and must be rectified to ensure that the accused is tried in accordance with the gravity of the offence.She also said that, to ensure a fair trial, it is imperative that the charges be amended.The case was registered by the Chandigarh Police on December 31, 2022, on the complaint of a junior woman coach.In her statement, she alleged that the minister molested her at his official residence on July 1, 2022. The woman alleged that when she resisted, he pushed her and tore her T-shirt, but she managed to escape.During the last hearing, the complainant supported her earlier statement given to the police and also identified her torn clothes (top wear) and her mobile phone.The FIR was registered at Sector 26 police station under Sections 354, 354-A, 354-B, 342, 506 and 509 of the IPC. Police filed a chargesheet on August 25, 2023, and the court framed charges on July 29, 2024.Sandeep Singh has denied the allegations, claiming before the court that he has been falsely implicated. He submitted that the complaint was filed with false accusations after the woman’s demands for training and posting were not met.
