Colonel, Major face court martial for irregularities in procurement of military stores

Two officers, a colonel and a major, are in the dock over alleged irregularities amounting to over Rs 2 crore in the procurement of military stores while posted with an Electronics and Mechanical Engineers battalion.The Army has ordered that the Colonel be tried by a general court martial (GCM), while the trial of the major is already underway at Meerut.Both officers have been attached to different brigades in Meerut under the Western Command.Also read: Army attaches Major General, several other officers for court martial proceedings in recruitment scamThe Colonel, who was then commanding the battalion, is facing 12 charges, which include five under the Prevention of Corruption Act, four under provisions of Section 52 of the Army Act that deals with misappropriation of property and intent to defraud and three alternate charges under Section 63 of the Army Act for acts prejudicial to good order and military discipline.Four charges have been levelled against the Major under Sections 52 and 63.Based on complaints, a court of inquiry, presided over by the commander of an Artillery Brigade, had held the major culpable of several acts of omission and commission, following which disciplinary action was initiated against him.During the proceedings, the alleged role of the Colonel, who was commanding an Electronics and Mechanical Engineers battalion, also emerged and the Army also moved to attach him for initiating disciplinary proceedings.The colonel, who had proceeded to attend the Higher Command Course at the Army War College, Mhow, moved the Armed Forces Tribunal against the proceedings. The tribunal ruled that since the course was about to end, the officer should be allowed to complete it before being attached.He had also contended before the Tribunal that he had earlier been awarded the punishment of ‘reproof’ and that therefore no charge sheet could have been issued to him as any fresh proceedings would amount to double jeopardy.The Army had submitted that the earlier punishment of ‘reproof’ awarded to the officer has since been revoked and fresh action is now being initiated as per the rules and power vested with the competent authority.The colonel had also moved the Delhi High Court for a stay on the proceedings, but in October 2025, a division bench of the High Court made it clear that the Army should proceed with the disciplinary action with due expedition.
