Suspended DIG of Punjab Police Harcharan Singh Bhullar and his close aide Krishanu Sharda have opposed a CBI application for a day-to-day trial of the corruption case against Bhullar.In the reply filed before Special Judge, CBI Chandigarh, through advocate SPS Bhullar, the accused suspended police officer said the CBI’s application was misconceived as even compliance of Section 230 BNSS had not yet been done completely.He said the legible and complete copies of documents relied upon by the prosecution as well as copies of un-relied documents were yet to be supplied to the accused. The application is in violation of well-settled tenets of fair trial.The application has the tendency of putting an embargo on legal issues that the accused has a right to raise and are fundamental to proceeding with the prosecution.It is yet to be decided by this court whether it is a case where charges can be framed and the trial can commence, and in such circumstances, the application filed by the CBI is completely misconceived and premature.He said that an incomplete chargesheet was hurriedly filed before this court in order to defeat the grant of default bail to the accused.The counsel of Krishanu Sharda argued that there was no direction in the orders of the Higher Courts for the “expeditious commencement and progression” of the trial. It is not understood on what basis the CBI seeks to place the present case on a different footing from other cases pending before this court. All provisions of law governing a fair trial are required to be complied with in letter and spirit and no prejudice should be caused to the defence.The accused and his counsel must be afforded sufficient time to prepare the case, as any hurried approach would cause grave prejudice and render the accused handicapped in placing the true facts before Court especially as the accused is in judicial custody and thus, the interaction between the accused and his counsel is subject to numerous constraints.The case cannot be treated as a special case so as to deviate from settled procedure.
