A contempt petition filed before the Punjab and Haryana High Court alleging non-compliance with an order directing the release of Majitha resident Jobanpreet Singh was on Friday dismissed as withdrawn. His arrest and detention was earlier declared illegal in a habeas corpus proceeding.Justice Sanjay Vashisth dismissed the petition as withdrawn while granting liberty to the petitioner to approach the magistrate concerned for issuance of further necessary directions. The petition was filed by Jobanpreet Singh’s father Mukhwant Singh seeking initiation of contempt proceedings against three police officials, including a sub-inspector, for allegedly disobeying the high court’s June 3 order passed in the habeas corpus petition.The bench took note of the submissions that the arrest of detainee Jobanpreet Singh in the FIR dated May 30 registered at the Majitha police station in Amritsar Rural district was held to be illegal by the high court. The petition was disposed of with the direction to release him from custody “as his initial detention is illegal being in contravention to the rights and protection envisaged under Article 21 and 22 (1) of the Constitution of India read with the relevant provisions of BNSS, 2023, and judicial pronouncements”.During the hearing of the contempt petition, Justice Vashisth observed the position which emerged before the court was that the petitioner took order dated June 3 directly to the jail authorities, without firstly approaching to the magistrate concerned for issuing direction/release warrant for release of detainee already confined in Amritsar Central Jail.“Faced with the situation, the counsel for the petitioner submits that he seeks withdrawal of the present petition with liberty to approach to the court of concerned magistrate, at first instance for issuance of further necessary direction. Dismissed as withdrawn with the aforementioned liberty,” Justice Vashisth concluded.
