The Delhi High Court on Friday granted a three-day interim bail to former JNU student leader Umar Khalid in the larger conspiracy case linked to the 2020 Delhi riots, allowing him to visit his ailing mother during her surgery.A Division Bench of Justice Prathiba M Singh and Justice Madhu Jain passed the order after observing that an empathetic approach was warranted in view of his mother’s medical condition.The court said Khalid would be released on interim bail from June 1 to June 3 so he could spend time with his mother while she underwent surgery. However, the Bench imposed stringent restrictions on his movement during the relief period.The judges directed that Khalid must remain within the National Capital Region and stay only at his designated residential address. He was permitted to travel solely between his residence and the hospital where his mother is admitted and barred from visiting any other location. The court also ordered that he must use only one mobile number during the bail period.The Bench further directed Khalid to furnish a personal bond and surety of Rs 1 lakh before his release.Khalid had approached the high court challenging a sessions court order dated May 19, rejecting his plea for interim bail. He had sought 15 days’ relief to care for his mother during her surgery and also participate in the Chehlum ritual of his uncle, who passed away last month.Opposing the plea, Additional Solicitor General SV Raju, appearing for the Delhi Police, argued before the court that the surgery appeared to be minor in nature and submitted that Khalid’s sisters could take care of their mother. He suggested that Khalid could instead be taken to the hospital under police escort for a day.During the hearing, the court sought details regarding the medical condition and surgery. Senior advocate Trideep Pais, appearing for Khalid, informed the Bench that his mother was suffering from a cyst on her back.Khalid was arrested in September 2020 in the Delhi riots conspiracy case and has been booked under multiple offences, including provisions of the Unlawful Activities (Prevention) Act. He continues to remain in custody as his regular bail plea is yet to succeed.
